Founded in 2007, the Law Office of Xochitl A. Quezada seeks to provide individuals with quality service throughout every step of their legal process. Our goal is to help you resolve the situation you are in with as little expense and emotional turmoil as possible. Ms. Quezada will evaluate your case to determine what options are available to you. Given the complex nature of family law and its tendency to cross over into other matters, we provide legal services in business law, bankruptcy, and unlawful detainers as well. Individuals and families are now finding themselves in unprecedented financial difficulties. As a result of the deflated market, increased unemployment, and inflated gas prices, people are forced to consider bankruptcy as an option.
Ms. Quezada understands how stressful consumer debt can be, Our office can help you prevent foreclosures, lawsuits, and wage garnishments. There are three commonly used chapters, 7, 11, and 13.
Chapter 7 offers individuals, businesses, and corporations an opportunity to eradicate most of their debts and start fresh. Clients will be able to keep some property including homes, cars, and retirement accounts as long as they qualify. Chapter 7 clients have to qualify via a means test. Chapter 11 and Chapter 13 is a reorganization of your debts. These chapters are for clients who can make payments and have up to five years to do so. The client also has to qualify to file a Chapter 11 and Chapter 13.

The decision to divorce is a difficult one to make particularly if children are involved. Ms. Quezada can help you through this emotionally and financially demanding time as painlessly as possible. In any divorce, there are complex issues to sort out such as division of assets, division of debt, child custody and visitation challenges, spousal support, and others. Once a Petition for Dissolution is filed, parties can seek temporary orders. Such temporary orders range from child custody to temporary spousal support. Ms. Quezada will also evaluate whether it will be necessary to retain experts that range from forensic accountants or psychological evaluators. Ms. Quezada has the experience and knowledge to help your divorce proceed smoothly.
One of the many issues facing divorcing parents today is that of child custody. Once parents make a decision to allow the court to make an order regarding custody, many individuals become involved in the process. The initial custody order is based on the best interest of the child test pursuant to the California Family Code. In very simple terms, the court will base its decision on the health, welfare, and safety of the child. Once a parent requests a hearing for child custody, the parents are immediately ordered to attend a Parent Orientation Program in Riverside County. This is a class to explain the mediation process. At this class, parents are encouraged to reach a mutually agreed child custody agreement. In most cases, parents cannot agree and are then given a mediation date. At mediation, the parents speak to a court appointed mediator about their wishes for child custody. Based upon this interview, the mediator will either help the parties reach an agreement or in the alternative, make a recommendation to the court regarding visitation.
Ms. Quezada is experienced in handling the sensitive issues surrounding child custody. She will represent your interests. Based on her experience, Ms. Quezada will be forthright regarding your chances for sole legal and physical custody. In the county of Riverside, absent evidence of domestic violence or drug abuse, the courts encourage joint custody arrangements. Nevertheless, her goal is to obtain the optimal benefits for you and your family.
Ms. Quezada will guide you through the process in a reassuring manner. She carefully explains the rights, laws, and the legal procedures to each client, so that they fully understand their options.
She listens to your concerns so that she can accurately articulate and address your wishes to the court. Ms. Quezada is knowledgeable in all types of custody, visitation, and other issues. She can help you reach sound decisions that guard the future of your children and your relationships with them.
The state of California will not recognize a man as the father of a child if the parties are not married. For a court to make a child custody order for unmarried couples, a party has to file a paternity suit. A paternity suit is the method by which a court can recognize the man as a father and make orders thereon. If there is doubt regarding paternity, then either party can request DNA testing. Otherwise, if there is no question of paternity, the voluntary declaration of paternity signed at the hospital at the time of the childs birth can be used to persuasively demonstrate that the man is the father. Nonetheless, if there is no question as to paternity, then the voluntary declaration of paternity is not necessary.
After signing the voluntary declaration of paternity, the man can still contest paternity by requesting a DNA test. In order to request a DNA test, one of the parties, after filing a petition to establish paternity, will have to ask the court to order that the man take a DNA test. In the meantime, the court will most likely not order visitation pending the results.
Establishing paternity will affect many important and fundamental parental rights, primarily child support, custodial time, visitation, and even your attorneys fees.
If a spouse, a partner, or a relative is physically, emotionally, or verbally abusing you then you can apply for a restraining order to prevent this kind of abuse. If the court finds that there is sufficient evidence, based on the face of the complaint, then the court will grant a temporary restraining order. About three weeks later, you will have to attend a hearing where the court will determine whether there is enough evidence to grant a permanent restraining order for up to five years.
If you are granted a permanent restraining order, then the restrained person:
May not contact you.
Stay away from you, your family, or the people that live with you.
Move out of your home.
Pay child support or spousal support.
Obey child custody and visitation orders
Not be allowed to possess a weapon.
Once a restraining order is issued, only the judge is authorized to revise or terminate the order. If the restrained person violates the restraining order then you call the police and the restrained person may be charged with violating the restraining order.
A civil harassment restraining order differs from a domestic violence restraining order based on the relationship you have with the restrained person. In a domestic violence restraining order the restrained person is a spouse, a domestic partner, a girlfriend/boyfriend, or family member. Whereas in a civil harassment restraining order, the restrained person can be a co-worker, neighbor, acquaintance, etc.
The California Code of Civil Procedure defines harassment as either: 1) unlawful violence (assault, battery or stalking other than in self-defense of others); 2) credible threats of violence (a statement or course of conduct willfully placing another in fear for safety of self and family member; or 3) a knowing and willful course of conduct directed at a specific person that seriously alarms, annoys or harasses that person, serves no legitimate purpose and would cause a reasonable person to suffer substantial emotional distress, and in fact causes the victim to suffer such distress.
It is more difficult to obtain a civil harassment restraining order than a domestic violence restraining order. In a civil harassment restraining order you have to prove harassment by clear and convincing evidence. This is the highest burden of proof in civil court. This means that you need sufficient evidence in the form of witnesses or documents to prove your case.
In addition, the prevailing party may be entitled to costs and attorneys fees. This means that if you cannot prove by clear and convincing evidence that you are being harassed, you may have to pay the other persons attorneys fees and costs. An attorney can be helpful in avoiding any legal hurdles and ensure the victims case is properly and effectively presented before the court.
